Moses Singer litigators Philippe Zimmerman, Daniel Hoffman and Collin Murdock successfully represented plaintiffs Alex Picken and Picken Real Estate Inc. in a jury trial against defendant RN Realty, LLC, to recover an unpaid real estate brokerage commission.  After a week-long trial, a Manhattan jury awarded our clients $1.1 million in damages.  With interest, the award is worth approximately $2 million.

Picken sued RN, the owner of the property located at 530 West 28th Street, because it refused to pay a brokerage commission in connection with its $45 million sale of the property in 2013. During the trial, we proved to the jury that Picken introduced RN to a prospective buyer, and that, after agreeing on terms acceptable to RN, RN stopped discussing a deal with that prospective buyer and sold the property to another buyer in order to avoid paying Picken a commission.

The Moses Singer litigation team is very pleased that the jury recognized that our clients were entitled to be paid for their work and that the defendant was not allowed to walk away from a deal in order to avoid paying a commission.
