Digital asset interval fund approvals face an uphill battle, since SEC Chair Gary Gensler’s approval of Bitcoin ETFs was “begrudging” and “teeth-gritting." While the SEC has conceded that Bitcoin isn’t a security, it has suggested that “practically every other cryptocurrency is,” said Fischer, who is also a former SEC senior trial counsel. Digital asset proponents should expect the SEC to remain hostile toward their industry, he added.
