Liz Corradino was quoted in a PRWeek article titled “How Content Creators Can Brush Up On Trademark Law To Protect Their Catchphrases.” The article highlights the importance of protecting catchphrases and explains the difference between a trademark and the federal registration of a trademark, and the rights to use a trademarked phrase.
Liz, a partner at Moses Singer, Chair of the IP, Entertainment, Media & Technology Practice, and the IP lawyer for the PR agency Hunter, said “If someone does not challenge it, trademarked phrases can be used in various ways as long as the use does not suggest an association between the user and the trademark owner.” She cautions, though, that “whether a use crosses that line can be a subtle legal question — best to steer clear without checking with your lawyer first. In rare cases, even relatively short phrases can be protected by copyright.”
