MS Forces Dismissal of Claim to Funk Band Tradename

Moses Singer attorneys Daniel Hoffman, David Rabinowitz and Rebecca Diamond fended off a federal claim to a funk band tradename made by the band’s ex-manager. They defeated a motion made against the band’s owner for a preliminary injunction stopping the band’s owner from using the name. In the Court’s decision denying the preliminary injunction motion, delivered from the bench on the day of the hearing, the Court made such scathing remarks about the ex-manager’s case that the ex-manager voluntarily dismissed the case a week later.

The case is Constance Hauman and Channel Creations LLC d/b/a Isotopia Records v. Miasha Fisher, Civil Action No.: 1:23-cv-06366-GHW-SDA (S.D. NY, September 18, 2023).
