In response to an August 20th ruling against the Federal Trade Commission's push to ban employment noncompete agreements, Avi stated that "noncompetes have been governed by state law in the U.S. for more than 150 years. There is noncompete law in at least 47 states, with courts typically taking a close look at the specific facts and law of a contract, before determining the circumstances under which a noncompete agreement may be valid and enforceable."
