Howard A. Fischer was quoted in a March 22, 2024 article about the SEC's suit against collapsed cryptocurrency project Terraform and its creator Do Kwon and whether the business deceived investors in the lead-up to the collapse that helped set off the so-called crypto winter.  

Howard said any new precedential value for crypto and securities laws that could come out of the case would have to come on appeal — Terraform and other crypto enforcement cases have yielded district court decisions ruling on whether digital assets are securities under specific facts and circumstances, but there has yet to be a binding ruling from an appellate court.
