Ultra-fast fashion giant Shein is under increasing legal scrutiny in dozens of cases from plaintiffs. Over 100 IP infringement lawsuits filed against it since 2020. Plaintiffs range from independent artists to major brands like Dr. Martens and Teva, accusing the company of systematically copying designs. A civil RICO lawsuit even alleges Shein uses AI-driven algorithms to replicate trends at the expense of creators.

The China-based company is known for selling inexpensive styles that draw on the newest trends, taking just days to emulate the latest aesthetic capturing attention on social media, while traditional fast fashion competitors can take weeks or months to capitalize on a trend. While IP battles are common in fashion, Shein's rapid production model raises questions about the effectiveness of current IP laws in protecting small designers. Meanwhile, Shein is also fighting back with its own infringement claims. "Fast fashion is just the old wine in new bottles," David Rabinowitz, a Moses Singer partner, told Law360, referring to the industry at large
