OECD National Contact Points provide an alternative dispute resolution forum that is increasingly used by civil society groups and labor unions to bring environmental, social, and governance (ESG) claims against global companies. While the processes are voluntary, they inform investor ratings and engagement, shape media campaigns, and provide a testing ground for future litigation. Responsible multinationals based in the US, Europe, and Australia take such proceedings seriously because the risks are material. But the processes and their implications can be opaque for those facing one for the first time. This session will provide an overview of OECD National Contact Point dispute resolution; explain the material business risks and opportunities to navigate; and provide practical insight regarding how to think about strategy tailored to the unique dynamics of business risk in the ESG arena.
