Moses & Singer Triumphs on Appeal

In a recent case reported in the New York Law Journal on July 28, 2006, Moses & Singer successfully represented a daughter against her brother and mother in proceedings commenced to ensure that neither the brother nor mother continue as Executor of the father's substantial estate because of the bad faith behavior of both the mother and her son. The five-judge Third Department appeals court unanimously affirmed the Surrogate's decision to remove the mother and to appoint a non-family person as successor, instead of the son who was named in the Will.
