Moses & Singer recently obtained a dismissal of a right of publicity claim on behalf of its client Edie Parker, LLC, one of the best known handbag and accessory designers in the fashion world.
In its decision granting defendant’s motion to dismiss, a Michigan federal court found that the plaintiff ‘s claim to rights in its name Edie Parker was preempted by the Trademark Act because defendant secured its exclusive right to use “Edie Parker” by obtaining eight federal trademark registrations. The complaint was dismissed in its entirety. A copy of the decision can be found in the pdf below.
