Moses & Singer Client Northern Leasing Wins Unanimous Decision

March 10, 2011

New York Law Journal ’s March 10, 2011 edition featured a court decision in favor of Moses & Singer client Northern Leasing Systems, Inc.

Northern Leasing Systems, Inc., Plf-Res, v. The Estate of  Edward M. Turner Def-Ap, the Court unanimously affirmed Northern’s motion to preclude defendants from introducing into evidence material not produced to plaintiff by a certain date, affirming the trial court's holding that the defendants and their counsel, Krishnan Chittur of Chittur & Associates, had willfully and "contumaciously" (i.e., in  a stubbornly disobedient way) refused to cooperate with discovery, and had failed to comply with three court orders directing defendants to produce documents and warning them of sanctions.  The case involves Northern's successful efforts to enforce three equipment finance leases against a corporate lessee and an individual guarantor.

Robert D. Lillienstein, Danielle S. Farber and Declan M. Butvick, attorneys in the firm's Litigation practice group, represented the client.
