EEOC Delays EEO Data Collections Due To COVID-19

In response to the worldwide pandemic wreaking havoc on businesses, the U.S. Equal Employment Opportunity Commission (“EEOC”) announced yesterday that it is giving employers a breather until at least March 2021 to report 2019 EEO-1 Component 1 data, which originally would have been due in March 2020.
The EEO-1 Report is a compliance survey mandated by federal statute and regulations. Businesses with at least 100 employees and federal contractors with at least 50 employees and a contract of $50,000 or more with the federal government must file the EEO-1 form each year. The EEO-1 form requires that employers report on the racial/ethnic and gender composition of their workforce by specific job categories, referred to as component 1 data.
The EEOC encouraged filers to prepare data submissions for 2021. Pending approval from the White House’s Office of Management and Budget, the EEOC expects to begin collecting 2019 and 2020 EEO-1 Component 1 data in March 2021. Collection of 2020 EEO-3 data (Local Union Reports), and 2020 EE0-5 data (Elementary-Secondary Staff Information Reports), has also been delayed and will likely begin in January 2021.
According to an EEOC press release, the delay will allow filers to be “better positioned to provide accurate, valid and reliable data in a timely manner.”
