Scott E. Silberfein is of counsel to Moses & Singer’s Litigation practice where he focuses on the representation of clients before federal and state courts, administrative tribunals, arbitration panels and mediators in bankruptcy, copyright, trademark, trade secret, restrictive covenant, construction and real estate matters.

Mr. Silberfein’s bankruptcy litigation experience includes the representation of creditors committees, individual creditors, both secured and unsecured, and debtors-in-possession. Representative clients include:
  • debtors of a large nursing home bankruptcy in Connecticut;
  • west-coast power companies in adversary proceedings related to two-way power contracts against a large energy company;
  • the unsecured creditors’ committee in a diamond-industry bankruptcy; and
  • an international banking institution in former Section 304 proceedings.

Mr. Silberfein's intellectual property experience is focused on the representation of domestic and foreign clients in the enforcement of intellectual property and licensing rights in federal court and the TTAB, as well as the preparation, filing and prosecution of trademark, and copyright applications. Representative intellectual property clients include:

  • the manufacturer of home fashions in trademark infringement litigations and TTAB opposition proceedings;
  • a major independent home entertainment distribution company in copyright and trademark infringement actions; and
  • a leader in the home textile industry in licensing litigations.

Other experience includes the successful representation of a distributor of medical, dental and veterinary supplies; an independent media agency network; and an insurance brokerage company in non-competition, non-solicitation, and misappropriation of confidential information and trade secret actions including the securing of temporary restraining orders and preliminary and permanent injunctions. Mr. Silberfein also represents a New York City-based construction services company in its litigations and arbitrations concerning breach of contract and lien foreclosure actions.

Prior to attending law school, Mr. Silberfein worked in Washington, D.C, in the legislative offices of Congressman Gary Ackerman and in the telecommunications industry.
