Eric P. Bergner joined Moses & Singer in 1991after graduating from New York University School of Law, where he was elected to The Order of Barristers, a national honor society. He is a partner at the firm, practicing in its Intellectual Property, Sports & Entertainment, Internet/Technology and Advertising practice groups.
Eric focuses his practice on helping clients exploit and monetize their content in various types of media – including electronic forms, such as online and mobile, and traditional forms, such as print and television. His strong transactional experience in the sports, entertainment and publishing industries includes representing such clients as the National Hockey League and New York Media (owner of New York magazine and NYMag.com). Eric assists these and other clients in producing, developing, licensing and distributing their content, as well as in advertising and promoting their content, including through the use of social media.
Having worked on numerous agreements for the development and distribution of apps on mobile devices and smart TVs, Eric has an in-depth understanding of the application development space. His extensive transactional experience in the software and technology arenas has served him well in this regard.
Eric also has a great deal of experience helping clients produce live events. He has turn-key experience in this arena, having drafted and negotiated agreements pertaining to, among other things, venue licensing, advertising and sponsorship sales, concession sales, and live performances by talent.
With nearly twenty years’ experience as a transactional lawyer, Eric has spent a significant amount of time working on agreements in the television, motion picture and music industries. He assists clients in selling and acquiring rights to formats, life stories, screenplays, music and other properties for use in audiovisual works, and drafts and negotiates talent and production agreements for various types of projects. Eric also deals with issues arising in connection with the distribution of programming, and has worked extensively on agreements for domestic syndication and international distribution.
Clients also benefit from Eric’s substantial knowledge in the advertising industry, as he has drafted and negotiated media buying and planning agreements, creative production agreements, market research agreements (for both custom and syndicated research), and barter agreements. Eric regularly guides clients through the complexities involved in protecting their intellectual property. He is responsible for a number of trademark programs (domestic and international), and prepares and files copyright registration applications. Eric also advises on and implements strategies to stop the unauthorized use of his clients’ IP.
