T: (212) 554-7868 F: (917) 206-4368 Mitchell D. Bernstein has been practicing law since 1988 and became associated with Moses & Singer in 1992. In 1999 he became a partner in the firm. Mr. Bernstein's practice is a varied one.
As a member of the firm's Intellectual Property/Entertainment practice, Mr. Bernstein counsels a variety of clients in the entertainment industry ranging from producers of award-winning children's television series, independent filmmakers, actors, writers, directors, reality and game show creators, website owners, and licensing and branding agents. Mr. Bernstein also manages the prosecution and protection of hundreds of domestic and international trademarks. Representative transactions include sales and acquisitions of television, film, theatrical and merchandising rights; film and theatrical financing; film and television distribution; talent and endorsement agreements; exploitation of traditional and new media rights; and various other licensing and branding transactions for "off-screen" exploitation. Mr. Bernstein is also involved in the production and investment of various film, theatre and television projects and proudly serves on the Board of Directors of the WorkShop Theater Company and as an Advisor to the Big Apple Film Festival.
As a member of the firm's Hotel and Hospitality practice, Mr. Bernstein works with owners, operators, franchisors, and licensors of international hotel, restaurant and spa brands, as well as NYC restaurants and bars on a variety of matters including operational, franchising, licensing and brand management issues. Representative transactions include the negotiation of management, lease and trademark licensing agreements for hotels, restaurants, and spas. Mr. Bernstein has lectured on the "Legal Aspects of Opening up a Restaurant" for both the Institute of Culinary Education and the Myriad Restaurant Group and on "Protecting Restaurant Names and Designs" for the American Conference Institute.
As a member of the firm's Litigation practice, Mr. Bernstein negotiates and litigates intellectual property and entertainment-related disputes (enforcement of IP rights, license agreements, copyright and trademark infringement/dilution/unfair competition actions, domain name disputes, actions for breach of contract/enforcement of restrictive covenants/accountings, and proceedings before the Trademark Trial and Appeal Board of the US Patent & Trademark Office (TTAB)).
