Robert J. Semaya is Of Counsel in Moses & Singer’s Litigation practice. He is an experienced litigator who represents a diverse group of commercial and real property matters before federal, state and local courts and administrative tribunals.  Bob’s clients include real estate developers, banks, financial services companies, manufacturers, retailers, hotel operators, restaurants, owners and operators of parking facilities and entertainment companies. 

In the area of real estate litigation, Bob has provides counsel on matters involving property ownership, tax liens and mortgage foreclosures.  His commercial litigation experience spans conflicts related to taxation, breach of contract, fraud, corporate dissolutions, partnership disputes and other business matters.

Prior to joining Moses & Singer, Bob was the partner in charge of the real estate foreclosure group at a prominent New York firm. In a recent case, before the New York City Tax Appeals Tribunal he was counsel to the sponsor of several cooperative apartment building conversions, successfully reversing a decision by an administrative law judge that exposed the former owners of the properties to $2 million in back unincorporated business tax.

Representative Matters

  • Represented a prominent real estate partnership in an arbitration dispute.  This led to a buyout by our client of the opposing petitioner at an advantageous price.
  • Advised a real estate client on a dispute involving the distribution of proceeds from the sale of properties.  We settled the dispute without litigation, obtaining a multi-million dollar payment considerably in excess of the bid first offered by the opposing party.
  • Won a complex real estate litigation case allowing the use of certain areas of a coop by our client, who held shares and leases for the commercial units in the building
  • Represented a leasing company on a real estate matter concerning the interpretation of lease provisions and drawdowns on a letter of credit.  We successfully obtained an injunction and prevented the termination of our clients lease, followed by negotiation of a new agreement favorable to the client.
