The Spring 2016 issue of Lexis Practice Advisor Journal features an article by Devika Kewalramani titled, "Avoid Stretching Your License Beyond its Legal and Ethical Limits." It discusses the impact of multijurisdictional practice on inhouse counsel who advise their organizational clients in multistate transactions and litigations, beyond their licensing jurisdictions. The article highlights the potential risks of unauthorized practice involving cross-border litigation activities by nonlegal organizations and their counsel in jurisdictions where they are not admitted to practice, but control, direct or manage licensed-outside counsel retained in pending litigation proceedings. A recent Florida Supreme Court decision illustrates how critical it is for inhouse counsel and their organizational clients to be vigilant about the degree of their involvement and to cautiously tread the delicate boundaries of permitted and prohibited litigation activities when crossing state lines.
